General Terms and Conditions (GTC) & Customer Information

§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts concluded between you as the customer and Najama (hereinafter referred to as “Provider” or “we”) via the online shop.
(2) The offer is aimed at consumers and businesses.

§ 2 Conclusion of contract and product characteristics (unique items)
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.
(2) Special feature of handcrafted production: With each Najama tree, you acquire a handcrafted, unique piece. Variations in structure, branch pattern, grain, and color nuances compared to the product photos are due to the manufacturing process and do not constitute a defect, but rather demonstrate the uniqueness of the product.
(3) Safety standards (RoHS): The goods comply with the requirements of EU Directive 2015/863 (RoHS) and have been tested according to IEC 62321 standards. They are free from harmful concentrations of lead, mercury, cadmium and other hazardous substances.

§ 3 Prices and Payment Terms
(1) The prices quoted include statutory VAT.
(2) The customer has the payment options shown during the ordering process.

§ 4 Delivery, shipping costs and installation
(1) Free shipping: We deliver free of charge within the specified delivery area.
(2) Delivery time & installation: Delivery is made via express service, usually within 7 days. Our service includes delivery to the point of use as well as the setup and alignment of the tree ("installation").
(3) Delivery delays: If pots or accessories are selected for the order that are not in stock, the delivery time may be extended accordingly. The customer will be informed of this.

§ 5 Statutory Right of Withdrawal
Consumers have a statutory right of withdrawal.

Cancellation policy

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.
To exercise your right of withdrawal, you must inform us (insert name, address, email here) of your decision by means of a clear statement.

Consequences of the revocation
If you cancel this contract, we will refund all payments received from you without undue delay and at the latest within fourteen days. We will collect the goods or you can return them (depending on the shipping company's agreement).

Return shipping costs in case of cancellation:
You will bear the direct costs of returning the goods. These costs are estimated at a maximum of approximately EUR 150.
(Note: This only applies to the statutory right of withdrawal, not the fit-or-swap guarantee).

§ 6 The Najama Guarantees
In addition to the statutory warranty rights, Najama offers the customer the following voluntary guarantees. These guarantees do not limit the statutory rights (in particular, warranty and right of withdrawal).

(1) 100 Day Fit or Swap Guarantee
If you do not like the tree, you can exchange it for another model from our range within 100 days of receipt.

  • Condition: The tree must be undamaged.

  • Costs: Delivery of the new tree is free of charge. We charge a flat fee of €150.00 for the return transport of the exchanged tree .

(2) 365-day accident warranty (parts replacement)
Should any leaves or branches fall off within 365 days of receipt (e.g. due to carelessness or material fatigue), we will send you the necessary replacement parts free of charge.

  • Support: You will receive repair instructions. Upon request, we can arrange a video call in which our experts will guide you through the installation.

(3) 3-year color and shape guarantee
We guarantee for a period of 3 years from the date of purchase that the trees will not fade or become deformed if treated properly.

§ 7 Warranty (Liability for Defects) and Exclusion of Guarantee
(1) The statutory provisions on liability for defects shall apply, unless otherwise specified below.
(2) Natural wear and tear or aging does not constitute a defect.
(3) Exclusion: The warranty and the guarantees mentioned in § 6 do not cover damages that occur after delivery due to improper handling. This includes, in particular:

  • Installation in outdoor areas (unless the product is explicitly marked as suitable for outdoor use).

  • Damage caused by extreme environmental influences (storm, hail, fire).

  • Changes to the product made by the customer that do not comply with the supplied instructions.

  • Use of aggressive cleaning agents that do not comply with the care instructions.

§ 8 Retention of Title
The goods remain our property until full payment is received.

§ 9 Transport damage
If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately.

§ 10 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR). We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions
German law applies. If the customer is a merchant, our place of business is the place of jurisdiction.
