General Terms and Conditions (GTC) & Customer Information

§ 1 Scope and Provider
(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between you as the customer and the company Najama (hereinafter "Provider" or "we") via the online shop.
(2) The offer is directed at consumers and entrepreneurs.

§ 2 Conclusion of Contract and Product Characteristics (Unique Items)
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog.
(2) Particularity of handcrafting: With each Najama tree, you are acquiring a handcrafted, unique item. Deviations in structure, branch progression, wood grain, and color nuances compared to the product photos are production-related and do not constitute a defect, but rather evidence the uniqueness of the product.
(3) Safety standards (RoHS): The goods comply with the requirements of EU Directive 2015/863 (RoHS) and are tested according to IEC-62321 standards. They are free of harmful concentrations of lead, mercury, cadmium, and other hazardous substances.

§ 3 Prices and Payment Terms
(1) The stated prices include the statutory value-added tax.
(2) The customer has at their disposal the payment options specified during the ordering process.

§ 4 Delivery, Shipping Costs, and Installation
(1) Free shipping: We deliver free of shipping costs to you within the specified delivery area.
(2) Delivery time & installation: Delivery is carried out via express, generally within 7 days. Our service includes delivery to the place of use as well as the setting up and alignment of the tree ("Installation").
(3) Delivery delays: Should pots or accessories be selected for the order that are not in stock, the delivery time may be extended accordingly. The customer will be informed of this.

§ 5 Statutory Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal.

Cancellation Policy

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (Insert here: name, address, email) by means of a clear declaration of your decision to withdraw from this contract.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and at the latest within fourteen days. We will collect the goods or you shall return them (depending on the forwarding agreement).

Costs of returning goods in the event of withdrawal:
You bear the direct costs of returning the goods. The costs are estimated at a maximum of approx. 150 EUR.

§ 6 Warranty (Liability for Defects)
(1) The statutory provisions governing liability for defects shall apply, unless otherwise stipulated below.
(2) Natural wear and tear or aging do not constitute a material defect.
(3) Exclusion: Excluded from the warranty are damages that have arisen after delivery due to improper handling. These include in particular:

  • Placement in outdoor areas (unless the product is explicitly marked as suitable for outdoor use).

  • Damage caused by extreme environmental influences (storm, hail, fire).

  • Modifications to the product made by the customer that do not comply with the supplied instructions.

  • Use of aggressive cleaning agents that do not comply with the care instructions.

§ 7 Retention of Title
The goods remain our property until full payment has been made.

§ 8 Transport Damage
If goods are delivered with obvious transport damage, please report such faults to the delivery agent as soon as possible and contact us without undue delay.

§ 9 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR). We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final Provisions
German law applies. If the customer is a merchant, our place of business shall be the place of jurisdiction.
